Overview

These Terms of Service ("Terms") govern your access to and use of the website, online store, customer accounts, specialist services, purchasing and trade-in services and other features made available by Swiss Watches GA, LLC, doing business as Swiss Watches Dot Com ("Swiss Watches Dot Com," "we," "us" and "our").

By accessing our website, creating an account, submitting information, placing an order or otherwise using our services, you agree to these Terms and to our Privacy Policy, Shipping & Delivery Policy, Final Sale & Order Protection policy, Limited Warranty, Bank Wire Transfer terms and the SMS terms in Section 5 of our Privacy Policy, each of which is incorporated by reference.

If you do not agree to these Terms, do not use our services.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to make a purchase through, or sell a watch to, Swiss Watches Dot Com.

We may request identity, payment, address, age, transaction or other verification information where reasonably necessary to complete a transaction, prevent fraud, comply with law or satisfy carrier, insurer, financial institution or payment processor requirements.

Independent pre-owned watch dealer

Swiss Watches Dot Com is an independent dealer of pre-owned luxury watches and related products. Swiss Watches Dot Com is not an authorized dealer, agent, representative, affiliate, sponsor or partner of any watch manufacturer or brand whose products appear on our website.

Brand names, model names, logos, trademarks and other intellectual property relating to third-party manufacturers remain the property of their respective owners and are used solely to identify and describe the watches offered.

Product condition

The watches sold by Swiss Watches Dot Com are pre-owned unless a listing states that a watch is unworn. Pre-owned watches may show signs of prior ownership or wear consistent with their disclosed condition grade.

Every listing states the reference, condition grade, polish status, whether the dial, hands, bezel, crown and bracelet are factory original or genuine manufacturer service replacements, known service history, the pressure-test result and exactly what is included. If an item is not listed, it is not included. Our grading scale and inspection process are described on our Authenticity Guarantee page.

Photographs depict the actual watch offered. Colors, reflections, proportions or surface details may appear differently depending on lighting, screen calibration and display settings. Customers are responsible for reviewing the complete listing before purchasing.

Authenticity

Every watch is authenticated and inspected by our watchmakers before it is listed, and every purchase is covered by our Lifetime Authenticity Guarantee, described on the Authenticity Guarantee page. Swiss Watches Dot Com does not sell watches with aftermarket components; a pre-owned watch may contain genuine manufacturer service parts installed during prior servicing, and the listing says so where known.

Nothing on our website constitutes a representation that Swiss Watches Dot Com is affiliated with or endorsed by any manufacturer.

Product availability

Our inventory may be offered through more than one sales channel. Placing an item in a cart, submitting checkout information or receiving an automated order confirmation does not necessarily reserve inventory or constitute final acceptance of an order. We reserve the right to withdraw an item, decline an order, limit quantities, correct a listing or cancel an unfulfilled transaction when reasonably necessary. If we cancel an order before fulfillment, your payment is returned in full.

Pricing

Prices are displayed in U.S. dollars. Applicable taxes, duties or other fees are added as disclosed during checkout or otherwise required by law. Despite our efforts to maintain accurate information, pricing or listing errors may occasionally occur; if an item is listed at an incorrect price or contains a material error, Swiss Watches Dot Com may correct the error or cancel an affected unfulfilled order.

Payment and verification

Accepted payment methods include major payment cards, digital wallets and bank wire transfer. Paying by bank wire reduces the watch price by the percentage shown at checkout; the wire price is available only when Bank Wire Transfer is selected as the payment method and cannot be combined with card or wallet payment. Wire instructions are provided only after a specialist confirms your order and identity by phone, and are never sent by text message or changed by email. Availability of a payment method does not guarantee approval. High-value or unusual transactions may be subject to additional identity, payment, fraud or ownership verification, and we reserve the right to decline a transaction if we cannot satisfactorily complete required verification. Orders suspected of fraud, unauthorized payment use, money laundering, sanctions violations or other unlawful activity may be cancelled or reported as required by law.

Final sale

All sales are final. Swiss Watches Dot Com does not offer refunds or exchanges, except under the Lifetime Authenticity Guarantee, for an order we cancel before fulfillment or cannot deliver as described, or where applicable law requires. Please review our Final Sale & Order Protection policy before purchasing. We welcome trade-ins toward another watch.

Limited Warranty

Every watch sold by Swiss Watches Dot Com is covered by our 1-Year Limited Warranty on the movement and water resistance from the date of delivery to the original purchaser. Coverage, exclusions and the claims procedure are set out in full in our Limited Warranty, which is provided solely by Swiss Watches Dot Com and is given in place of any manufacturer's warranty.

Nothing in these Terms restricts rights that cannot lawfully be waived.

Selling or trading a watch to us

When you offer a watch to Swiss Watches Dot Com for purchase or trade-in, you represent that you are at least 18, located in the United States, the lawful owner of the watch and entitled to sell it. Quotes are based on your description and are confirmed after our watchmakers inspect the watch on video on arrival. If the watch matches your description the quote stands; if not, you receive an itemized list of deductions and may decline, in which case the watch is returned to you free and insured. We may decline any watch. Watches found to be counterfeit, stolen, fitted with aftermarket diamonds or non-genuine parts are declined and, where the law requires, reported. Accounts

Certain website functionality may require an account. You agree to provide accurate and current information, keep your sign-in codes confidential, accept responsibility for activity conducted through your account and promptly notify us of suspected unauthorized access. You may not impersonate another person, create accounts using false information or use another person's account without permission.

Acceptable use

You may use our website only for lawful purposes. You may not:

• attempt to gain unauthorized access to our website, accounts, systems, servers or databases;

• introduce malware, malicious code or other harmful technology;

• interfere with the security, performance or normal operation of the website;

• use bots, scrapers, crawlers, automated extraction tools or similar technologies to systematically collect information without permission, except legitimate search-engine indexing;

• use information obtained through our website to commit fraud or other unlawful acts;

• provide false or misleading information in connection with purchasing, selling or trading a watch;

• infringe the intellectual-property, privacy or other legal rights of Swiss Watches Dot Com or another party; or

• use our services in violation of applicable financial, sanctions, anti-money-laundering, trade or consumer-protection law.

Intellectual property

Unless otherwise indicated, the design, layout, text, graphics, product descriptions, photographs, videos, logos, custom artwork, software and other original content created for Swiss Watches Dot Com are owned by or licensed to Swiss Watches GA, LLC and are protected by applicable intellectual-property laws. You may access the website for ordinary personal and commercial shopping purposes. You may not reproduce, republish, distribute, sell, scrape, commercially exploit, modify or create derivative works from protected content without permission except as permitted by law.

Third-party services

Our website may contain links to or integrate services operated by third parties, including payment providers, carriers, analytics services, messaging and social-media platforms. Those services are governed by their own terms and privacy policies. Swiss Watches Dot Com is not responsible for third-party services except to the extent required by applicable law.

Market values and information

Any pricing guidance, valuation estimate, market commentary or similar information provided through our website or by a specialist is informational and may change over time. Luxury watch markets fluctuate. Unless expressly stated in a written agreement, such information is not a guarantee of future value, investment performance, resale price or liquidity and does not constitute financial or investment advice.

Warranties and disclaimer

Each watch is covered by the express Limited Warranty described above and by the express representations made in its listing. Any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the one-year Warranty Period of the Limited Warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This gives you specific legal rights, and you may also have other rights which vary from state to state.

The website itself is provided on an "as is" and "as available" basis. We do not guarantee that the website will always operate without interruption, delay or error. Nothing in this section excludes any warranty or other right that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by applicable law, Swiss Watches Dot Com will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from use of the website or a transaction. To the fullest extent permitted by law, our aggregate liability relating to an individual transaction will not exceed the amount paid to Swiss Watches Dot Com for the product giving rise to the claim. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. These limitations do not apply to liabilities that cannot lawfully be limited or excluded.

Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles, except where applicable law requires otherwise. Subject to rights that cannot legally be waived, disputes relating to these Terms or the use of our website shall be resolved in the state or federal courts having jurisdiction in Fulton County, Georgia.

Changes to these Terms

We may revise these Terms from time to time. The version published on our website at the time of use will apply, subject to applicable law. Material changes will be communicated where legally required.
